ജീവിക്കാനും സ്വകാര്യതയ്ക്കും തുല്യതയ്ക്കുമുള്ള അവകാശങ്ങളില്‍ ലൈംഗികാഭിരുചിയേയും ഉള്‍പ്പെടുത്തുന്നതാണ് ചരിത്രവിധി. ഭരണഘടന വിഭാവനം ചെയ്യുന്ന തുല്യതയ്ക്കുളള അവകാശത്തെ ലംഘിക്കുന്നതായിരുന്നു 377–ാം വകുപ്പ്. സ്വവര്‍ഗരതിയെ രാജ്യവും പൊതുസമൂഹവും അംഗീകരിക്കുവാന്‍ വേണ്ടി ലൈംഗിക ന്യൂനപക്ഷങ്ങള്‍ പൊരുതുവാന്‍ തുടങ്ങിയിട്ട ഒന്നര നൂറ്റാണ്ടായി.

ബ്രിട്ടീഷ് നിർമിതവും കൊളോണിയൽ കാലത്ത് പ്രാബല്യത്തിൽ വന്നതുമായ ഒരു നിയമം ആണ്. ഇത് പ്രകാരം ഗര്ഭധാരണത്തിന് വേണ്ടി അല്ലാതെയുള്ള ദമ്പതികളുടെ ലൈംഗികബന്ധം, ട്രാൻസ് ജൻഡറുകളുടെ ലൈംഗികത, സ്വവർഗ അനുരാഗം എന്നിവ കുറ്റകരമാണ് എന്ന് വിലയിരുത്തുന്നു. പത്തുവർഷംവരെ തടവും പിഴയും ഉൾപ്പെടെയുള്ള ശിക്ഷകൾ ഇത് പ്രകാരം വിധിക്കാൻ ഇത് പ്രകാരം കോടതിയ്ക്ക് കഴിയും. അതിനാൽ ലൈംഗിക ആസ്വാദന രീതികൾ വച്ചു പുലർത്തുന്ന ദമ്പതികൾ, ട്രാൻസ് ജെൻഡറുകൾ ഉൾപ്പടെയുള്ള ലൈംഗികന്യൂനപക്ഷങ്ങൾ എന്നിവർ ക്രിമിനൽ കുറ്റവാളികളായി ചിത്രീകരിക്കപ്പെടുന്നു. എന്നാല്‍ ഈ നിയമം രാധാക്കുന്നതോടെ ഇനി സമൂഹത്തില്‍ വിപ്ലബ്വകരമായ മാറ്റങ്ങള്‍ പ്രതീക്ഷിക്കാം

Supreme Court has agreed to re-examine its verdict on homosexuality where in it had upheld the validity of section 377. The apex court has referred to five-judge Constitution Bench to hear curative plea. On December 12, 2013 the apex court had upheld the validity of section 377. by doing so, the court had set aside the Delhi High Court verdict of July 2, 2009 by which it had read down section 377 and decriminalizing consensual sex between the adults of same gender.

The Supreme Court on Tuesday referred to a five-judge bench a curative petition against Section 377 of the Indian Penal Code which criminalises homosexuality. The decision by a bench headed by Chief Justice TS Thakur was immediately welcomed by gay rights activists across the country as it reopens the legal debate on homosexuality. The apex court clubbed together 8 curative petitions filed by gay rights activists and NGO Naz Foundation against the apex court's December 11, 2013 judgement upholding validity of section 377 (unnatural sexual offences) of IPC and the January 2014 order, by which it had dismissed a bunch of review petitions.
