ജീവിക്കാനും സ്വകാര്യതയ്ക്കും തുല്യതയ്ക്കുമുള്ള അവകാശങ്ങളില് ലൈംഗികാഭിരുചിയേയും ഉള്പ്പെടുത്തുന്നതാണ് ചരിത്രവിധി. ഭരണഘടന വിഭാവനം ചെയ്യുന്ന തുല്യതയ്ക്കുളള അവകാശത്തെ ലംഘിക്കുന്നതായിരുന്നു 377–ാം വകുപ്പ്. സ്വവര്ഗരതിയെ രാജ്യവും പൊതുസമൂഹവും അംഗീകരിക്കുവാന് വേണ്ടി ലൈംഗിക ന്യൂനപക്ഷങ്ങള് പൊരുതുവാന് തുടങ്ങിയിട്ട ഒന്നര നൂറ്റാണ്ടായി.
എന്തായിരുന്നു ഈ 377–ാം വകുപ്പ്.സ്വന്തം ലൈംഗിക പങ്കാളിയെ തിരഞ്ഞെടുക്കാനുള്ള അവകാശം ഈ നിയമം തടസ്സപ്പെടുത്തി
