അഡല്‍ട്ടറി അഥവാ പരസ്ത്രീബന്ധം ശിക്ഷാര്‍ഹമാക്കുന്ന നിയമം പുന:പരിശോധിക്കണമെന്ന് സുപ്രീംകോടതി കേന്ദ്ര സര്‍ക്കാറിനോട് ആവശ്യപ്പെട്ടു.ഇന്ത്യന്‍ ശിക്ഷാ നിയമത്തിലെ 497 ാം വകുപ്പ് കാലഹരണപ്പെട്ടതും പൗരാണികവുമാണെന്ന് സുപ്രീംകോടതിയുടെ നിരീക്ഷണം. ഐപിസി 497ാം വകുപ്പ് ലിംഗ സമത്വത്തിന് എതിരാണെന്ന് ചൂണ്ടിക്കാട്ടി നല്‍കിയ പൊതുതാത്പര്യ ഹര്‍ജിയിലാണ് സുപ്രീംകോടതി കേന്ദ്രസര്‍ക്കാരിന്റെ വിശദീകരണം തേടിയത്.ഐപിസി(ഇന്ത്യന്‍ ശിക്ഷാ നിയമം) 497ാം വകുപ്പ് പ്രകാരം വിവാഹേതര ബന്ധത്തില്‍ ഏര്‍പ്പെടുന്ന പുരുഷന് എതിരെ മാത്രമേ കേസ് എടുക്കാനും ശിക്ഷിക്കാനും വ്യവസ്ഥയുള്ളു. സ്ത്രീക്ക് എതിരെ കേസ് രജിസ്റ്റര്‍ ചെയ്യാന്‍ വ്യവസ്ഥയില്ല. അതിനാല്‍ വിവാഹത്തിന് ശേഷം മറ്റൊരു സ്ത്രീയുമായി ബന്ധമുള്ള പുരുഷന് ശിക്ഷിക്കപ്പെടുമ്പോള്‍ പരപുരുഷനുമായി ബന്ധമുള്ള സ്ത്രീയെ നിയമം സംരക്ഷിക്കുകയാണ് ചെയ്യുന്നത്. അത്തരം കേസുകളിലും സ്ത്രീയുമായി ബന്ധമുള്ള പുരുഷന് മാത്രമാണ് ശിക്ഷിക്കപ്പെടുന്നത്. ഡിവോഴ്‌സ് കേസുകളില്‍ മാത്രമാണ് പരപുരുഷ ബന്ധവും പരസ്ത്രീ ബന്ധവും ഒരുപോലെ പരിഗണിക്കപ്പെടുന്നത്.

सुप्रीम कोर्ट ने पुलिस पर सख्ती दिखाते हुए अहम आदेश दिया है...कोर्ट ने कहा है कि देशभर के थानों में दर्ज एफआईआर को 24 घंटे के भीतर पुलिस या राज्य सरकार की वेबसाइट पर अपलोड किया जाना चाहिए...कोर्ट ने यह भी कहा कि यदि किसी तकनीकी कारण से दिक्कत आती है तो एफआईआर को 48 घंटे में अपलोड किया जाना अनिवार्य है...कोर्ट ने इस मामले से महिलाओं के साथ यौन शौषण, बच्चों के यौन शोषण, आतंकवाद और विद्रोह जैसे संवेदनशील मामलों में छूट दी है. कोर्ट ने कहा कि ऐसे मामलों में एफआईआर अपलोड करने की जरूरत नहीं है. सिक्किम, मिजोरम, मेघालय और कश्मीर जैसे राज्यों की भौगोलिक हालात अलग हैं वहां 72 घंटे में अपलोड करने का समय कोर्ट ने तय कर दिया है. कोर्ट ने कहा कि कौन सा अपराध संवदेनशील है और FIR अपलोड नहीं होनी चाहिए, ये DSP या DM तय करेगा...सुप्रीम कोर्ट ने साफ किया, अगर FIR अपलोड नहीं हुई तो इसके आधार पर कोई आरोपी अग्रिम जमानत नहीं ले सकता है।--
