അല്ലാത്തപക്ഷം നിയമ ലംഘനത്തിനു പുറമെ കർശന ബാധ്യതകളും ചുമത്തണം. . പ്രതിഷേധിക്കാനുള്ള അവകാശത്തേക്കാൾ മുകളിലാണു പൗരനു ജീവിക്കാനുള്ള അവകാശമെന്നു കോടതി നിരീക്ഷിച്ചു.നാളെ മുതൽ രണ്ടു ദിവസം നടക്കുന്ന പണിമുടക്കിൽ അനിഷ്ട സംഭവങ്ങൾ ഒഴിവാക്കാൻ നടപടികൾ പൊലീസ് സ്വീകരിച്ചതായി സർക്കാർ കോടതിയെ അറിയിച്ചു. കെഎസ്ആർടിസി ബസുകൾക്ക് സുരക്ഷ ഒരുക്കും.
പൊലീസ് സുരക്ഷ ആവശ്യപ്പെടുന്ന വ്യക്തികൾക്കും സ്ഥാപനങ്ങൾക്കും സുരക്ഷ നൽകുമെന്നും സർക്കാർ കോടതിയിൽ അറിയിച്ചു. പണിമുടക്കിൽ ജനങ്ങൾക്കു ബുദ്ധിമുട്ടുണ്ടാകാതിരിക്കാൻ എന്തു നടപടി സ്വീകരിച്ചു എന്ന് വ്യക്തമാക്കണമെന്നു കോടതി ആവശ്യപ്പെട്ടിരുന്നു. സംസ്ഥാനത്ത് ജനജീവിതം സ്തംഭിപ്പിച്ചു തുടർച്ചയായി നടക്കുന്ന ഹർത്താൽ വിഷയത്തിൽ ഹൈക്കോടതി സംസ്ഥാന സർക്കാരിന്റെ നിലപാട് ആരാഞ്ഞു. ഹർത്താലുകളും സമരങ്ങളും സംസ്ഥാനത്ത് നിരോധിക്കണമെന്ന് ആവശ്യപ്പെട്ട് കേരള ചേംബർ ഓഫ് കൊമേഴ്സ് ആൻഡ് ഇൻഡസ്ട്രി, തൃശൂരിലെ മലയാളവേദി തുടങ്ങിയവർ സമർപ്പിച്ച പൊതു താൽപര്യ ഹർജി പരിഗണിക്കുമ്പോഴാണ് ഇത്.ഹർത്താലിൽ നടക്കുന്ന അക്രമങ്ങൾ ഭരണഘടനാ വിരുദ്ധമാണ്. ഇതു ജനങ്ങളുടെ മൗലിക അവകാശത്തെയാണു ബാധിക്കുന്നത്. അക്രമങ്ങൾ തടയാൻ സമഗ്രമായ പദ്ധതി വേണം.
പ്രതിഷേധിക്കാൻ എല്ലാവർക്കും അവകാശമുണ്ട്. എന്നു കരുതി മറ്റുള്ളവരെ അതിൽ നിർബന്ധിച്ചു പങ്കെടുപ്പിക്കരുത്.
ഹർത്താൽ വെറും തമാശ പോലെയായി മാറുകയാണ്. ഹർത്താലുകൾ മൂലം ഓഫിസുകളുടെയും സ്കൂളുകളുടെയും പ്രവൃ ത്തി ദിനങ്ങൾ കുറയുകയാണ് – കോടതി വ്യക്തമാക്കി.ഹർത്താലിനെതിരായി ഉയരുന്ന ജനവികാരം അതു നടത്തുന്നവർ കാണുന്നില്ല എന്നുണ്ടോ എന്നു ചോദിച്ച കോടതി സ്ഥിരമായി അക്രമം നടക്കുന്ന സ്ഥലങ്ങൾ തിരിച്ചറിഞ്ഞിട്ടുണ്ടോയെന്നും എന്തുകൊണ്ടാണു നിയമ നിർമാണം നടത്താത്തതെന്നും സർക്കാരിനോടു ചോദിച്ചു.
2018ൽ മാത്രം സംസ്ഥാനത്തു 97 ഹർത്താലുകൾ നടത്തിയെന്നും കഴിഞ്ഞ ഒരു വർഷത്തിനിടെ ഇത്രയും ദിവസങ്ങൾ ജനജീവിതം സ്തംഭിച്ചെന്നും കേരള ചേംബർ ഓഫ് കൊമേഴ്സിന്റെ ഹർജിയിൽ ആരോപിക്കുന്നു. ഹർത്താൽ ദിനങ്ങളിൽ പൊതുമുതലിനുണ്ടാകുന്ന നാശനഷ്ടങ്ങൾ തിട്ടപ്പെടുത്താൻ ക്ലെയിംസ് കമ്മിഷനെ നിയമിക്കണമ.

സംസ്ഥാനത്ത് 2017-ൽ 121 ഹർത്താലുകളും 2018-ൽ ഇതുവരെ 97 ഹർത്താലുകളും നേരിടേണ്ടിവന്നു.
ശരാശരി 100 ഹർത്താലുകൾ ഒരു വർഷം ഉണ്ടാകുമ്പോൾ വ്യാപാര-വ്യവസായ-ടൂറിസം മേഖലകളിലായി കോടിക്കണക്കിന്‌ രൂപയുടെ നഷ്ടം സംഭവിക്കുന്നു.
സർക്കാർകണക്കുകൾപ്രകാരം ഏകദേശം 1.65 കോടിയോളം ആഭ്യന്തര-വിദേശ വിനോദസഞ്ചാരികളാണ് കേരളത്തിലെത്തുന്നത്. ദിവസം 70,000 പേരെങ്കിലും എത്തുന്നുണ്ട്. ഹർത്താലുകൾ വിനോദസഞ്ചാരമേഖലയ്ക്ക് ഒരു ദിവസം ഏകദേശം 200 കോടി രൂപയുടെ നഷ്ടമുണ്ടാക്കുന്നുവെന്നാണ് കണക്കെന്ന് ഹർത്താലിനെതിരേ കൊച്ചിയിൽ ട്രാവൽ മാർട്ട് സൊസൈറ്റി (കെ.ടി.എം.) വിളിച്ച യോഗം വ്യക്തമാക്കി. സഞ്ചാരസ്വാതന്ത്ര്യം ഉറപ്പുവരുത്തുന്നതിന് സർക്കാർ-പോലീസ് സഹായം തേടുക എന്ന ആവശ്യം യോഗം ഉന്നയിച്ചു.
ഫോട്ടോ, വീഡിയോ തുടങ്ങിയ തെളിവുകളുടെ സഹായത്തോടെ പ്രശ്നക്കാർക്കും ഹർത്താൽ പ്രഖ്യാപിക്കുന്നവർക്കും എതിരേ നഷ്ടപരിഹാരത്തിന് നടപടിയെടുക്കുക, സഞ്ചാരസ്വാതന്ത്ര്യം സംബന്ധിച്ച ഹൈക്കോടതി വിധി ലംഘിക്കപ്പെട്ടാൽ കോടതിയലക്ഷ്യ നടപടികൾ സ്വീകരിക്കുക തുടങ്ങിയ ആവശ്യങ്ങളും യോഗം ഉന്നയിച്ചു.
സ്വതന്ത്രവിഹാരവും ജോലിചെയ്ത് ജീവിക്കാനുള്ള അവകാശവും സംരക്ഷിക്കുന്നതിന് രാഷ്ട്രീയപാർട്ടികൾക്കിടയിൽ അഭിപ്രായസമന്വയമുണ്ടാക്കാൻ സർവകക്ഷിയോഗം വിളിക്കണമെന്ന് സർക്കാരിനോട് ആവശ്യപ്പെടും. ഹർത്താലിനെതിരേ പോരാടാൻ എല്ലാ വ്യാപാരസ്ഥാപനങ്ങളുടെയും സഹകരണത്തോടെ സംയുക്തഫോറം രൂപപ്പെടുത്താനും തീരുമാനിച്ചു.
ബന്ദും ഹർത്താലുമുള്ളപ്പോൾ കടകൾ തുറക്കാനും വാഹനങ്ങൾ ഓടിക്കാനും വാണിജ്യ-വ്യവസായ മേഖലയിലെ 36 സംഘടനകളുടെ ഹർത്താൽ വിരുദ്ധകൂട്ടായ്മയിൽ തീരുമാനം.

ഹര്‍ത്താല്‍ തടയുന്നതിനുള്ള നിയമ വശങ്ങൾ പരിശോധിക്കുമെന്നും ഹര്‍ത്താലുകള്‍ ഒഴിവാക്കാന്‍ സര്‍വകക്ഷിയോഗം വിളിക്കാന്‍ തയ്യാറാണെന്നും മുഖ്യമന്ത്രി പിണറായി വിജയന്‍. നിയമസഭയിലെ ചോദ്യോത്തര വേളയിലായിരുന്നു മുഖ്യമന്ത്രിയുടെ പ്രതികരണം. കേരളത്തിന്റെ മുന്നോട്ടുള്ള പോക്ക് തടയാനുള്ള ബോധപൂര്‍വ ശ്രമം നടക്കുന്നുണ്ട്. സംസ്ഥാനത്തിന് ദുഷ്‌പേര് ഉണ്ടാക്കുന്ന തരത്തില്‍ ചില ഹര്‍ത്താലുകള്‍ നടത്തി. ഹര്‍ത്താലില്‍ അക്രമം നടത്തിയവര്‍ക്കെതിരെ ശക്തമായ നടപടിയാണ് എടുത്ത് വരുന്നതെന്നും മുഖ്യമന്ത്രി അറിയിച്ചു.അതേ സമയം ഹര്‍ത്താല്‍ നിയമവിരുദ്ധമാക്കാനുള്ള നടപടികളെ സംബന്ധിച്ചുള്ള ചോദ്യത്തിന് മുഖ്യമന്ത്രി കൃത്യമായ മറുപടി പറഞ്ഞില്ല.
മിന്നല്‍ ഹര്‍ത്താലുകള്‍ ജനങ്ങള്‍ക്ക് ഏറെ ബുദ്ധിമുട്ടുകളുണ്ടാക്കിയതായി പ്രതിപക്ഷ നേതാവ് രമേശ് ചെന്നിത്തല പറഞ്ഞു. ഹര്‍ത്താല്‍ നിയന്ത്രണ ബില്‍ നിയമസഭയില്‍ അവതരിപ്പിച്ച് പാസാക്കാന്‍ സര്‍ക്കാര്‍ തയ്യാറാകുമോ എന്നും പ്രതിപക്ഷ നേതാവ് ചോദിച്ചു. ആദ്യം പുറത്ത് ചര്‍ച്ചകള്‍ നടത്താം പിന്നീട് നമുക്ക് സഭാനടപടികളിലേക്ക് കടക്കാമെന്നായിരുന്നു മുഖ്യമന്ത്രിയുടെ മറുപടി. ശബരിമല സ്ത്രീപ്രവേശനം നടന്നതിന് പിറ്റേ ദിവസം നടത്തിയ ഹര്‍ത്താലില്‍ പൊതുമുതല്‍ നശിപ്പിച്ച വകയില്‍ 28.43 ലക്ഷം രൂപയും സ്വകാര്യ മുതല്‍ നശിപ്പിച്ച വകയില്‍ 1.03 കോടിരൂപയുടേയും നഷ്ടം കണക്കാക്കിയിട്ടുണ്ട്. കേരളത്തിന്റെ വികസനത്തിന് ഇതേവരെ ഒരു പങ്കുംവഹിക്കാത്ത ചില ശക്തികള്‍ ബോധപൂര്‍വം അക്രമം അഴിച്ചുവിടുന്നു. അവര്‍ക്ക് കേരളം മുന്നോട്ട് പോകരുത് എന്ന് മാത്രമല്ല. പിന്നോട്ടടിപ്പിക്കാനാണ് ആഗ്രഹമെന്നും മുഖ്യമന്ത്രി പറഞ്ഞു.
