After meeting Kourtney, 34, during a 2008 photo shoot for 944 magazine, Michael says they began texting, according to TMZ. In the legal documents he says he has filed, he claims that Kourtney allegedly said she had Scott Disick, 30, were “on the outs” and “she wanted to hang.”
He explained in the paperwork the two had ”unprotected vaginal sex,” and that he “ejaculated inside [Kourtney's] vagina.” Another claim states that Kourtney and Scott’s second child, Penelope Scotland Disick, looks nothing like Mason.
After the birth of Mason on December 14, 2009, he saw the resemblance — since she did show the whole world the graphic birth — and tried reaching out to Kourtney. However, he never got any response.
By taking it to court, he is requesting joint custody of Mason, as well as DNA tests for Kourtney, Scott, Mason and him..

In the court documents he filed in L.A. County Superior Court, Michael is requesting a DNA test for Kourtney, Scott, Mason and himself. And he wants joint-custody of Mason. The judge set a hearing for next month.
Kourtney's attorney, Shawn Holley (of LiLo fame) says Michael's allegations are 'false and defamatory.'

Los Angeles-based model Michael Girgenti filed a paternity lawsuit Thursday asking for joint custody of Kardashian's 3-year-old son, Mason Dash Disick, according to TMZ.
In legal documents obtained by the gossip site, Girgenti described an alleged sexual encounter with the 34-year-old reality starlet that is said to have come after he met her during a photo shoot in August 2008.
Girgenti first said he could be the child's father in a March 2013 interview with In Touch Weekly.
The 26-year-old's suit reportedly states that he had 'unprotected vaginal sex' with Kardashian in March 2009 when she and boyfriend Scott Disick were on the outs. The date happens to be nine months before Mason's December 2009 birth.
Girgenti told In Touch that he 'began to wonder' if he was Mason's dad after he 'saw photos of him.'
He said he tried to make contact with Kardashian after their fling, but she did not return his attempts.
A lawyer for the mother of two called these accusations 'preposterous and an outrageous lie.'
