ശബരിമല കേസില്‍ വാദം പൂര്‍ത്തിയായി; വിധി ഇന്നില്ല; അവസരം ലഭിക്കാത്തവര്‍ക്ക് വാദങ്ങള്‍ എ‍ഴുതി നല്‍കാന്‍ സുപ്രീം കോടതി ഒരാ‍ഴ്ച സമയം നല്‍കി.ശബരിമല വിധിയുടെ പുന പരിശോധനയുമായി ബന്ധപ്പെട്ട വാദങ്ങള്‍ പൂര്‍ത്തിയായി. ഹര്‍ജികളില്‍ വിധി ഇന്നുണ്ടാവില്ല. ഹര്‍ജികളില്‍ വാദം പൂര്‍ത്തിയായതിനെത്തുടര്‍ന്നാണ് വിധി പറയാന്‍ മാറ്റിയത്.വാദ ത്തിന് അവസരം ലഭിക്കാത്തവര്‍ക്ക് വാദം എ‍ഴുതി നല്‍കാമെന്ന് സുപ്രീം കോടതി വ്യക്തമാക്കിയിരുന്നു. ഏ‍ഴു ദിവസത്തിനുള്ളില്‍ വാദം എ‍ഴുതി നല്‍കാനാണ് കോടതി ഉത്തരവിട്ടിരിക്കുന്നത്.വിധിയില്‍ പുനഃപരിശോധന ആവശ്യമില്ലെന്ന് സര്‍ക്കാര്‍ കോടതിയില്‍ വ്യക്തമാക്കി.സംസ്ഥാന സര്‍ക്കാറിന് വേണ്ടി അഡ്വ. ജയദീപ് ഗുപ്ത ഹാജരായി. പലവാദങ്ങളും കേട്ടിട്ടില്ലെന്നത് പുന പരിശോധനയ്ക്ക് കാരണമല്ലെന്നും വിധിയ്ക്ക് ആധാരം തുല്യതയെന്നും സര്‍ക്കാര്‍ കോടതിയില്‍ വ്യക്തമാക്കി.തുല്യതയും വിവേചനമില്ലായ്മയും ഭരണഘടന ഉറപ്പു വരുത്തുന്നതാണ്. ഇത് പാലിച്ചു കൊണ്ടുള്ള വിധിയാണ് ശബരിമലയിലെ ഇപ്പോ‍ഴത്തെ വിധി. ക്രമ സമാധാനം തകര്‍ന്നുവെന്നത് വിധി പുന പരിശോധിക്കാനുള്ള ഒരു കാരണമല്ലെന്നും സര്‍ക്കാര്‍ കോടതിയില്‍ വ്യക്തമാക്കി. ഹെെക്കോടതിയിലെ കേസുകള്‍ കൂടി സുപ്രീം കോടതിയിലേക്ക് മാറ്റണമെന്നും നിരീക്ഷണ സമിതിയുടെ ആവശ്യമില്ലെന്നും സര്‍ക്കാര്‍ കോടതിയില്‍ വ്യക്തമാക്കി.സര്‍ക്കാര്‍ കോടതിയില്‍ നടത്തിയ പ്രധാന വാദങ്ങള്‍,1.വിധിയില്‍ പുനപരിശോധന ആവശ്യമില്ല
2.പുതിയ ഒരു വാദവും ഉന്നയിക്കാന്‍ ഹര്‍ജിക്കാര്‍ക്ക് കഴിഞ്ഞിട്ടില്ല.
3.വിധിക്ക് ആധാരം തുല്യത
4. പുനപരിശോധനയ്‌ക്ക് തക്കതായ പിഴവ് വിധിയില്‍ ഇല്ല.
5. തുല്യതയാണ് വിധിയുടെ അടിസ്ഥാനം, തൊട്ടുകൂടായ്‌മ അല്ല
6.ആചാര പ്രത്യേകത പരിഗണിച്ചാല്‍ എല്ലാ ക്ഷേത്രങ്ങളും പ്രത്യേക വിശ്വാസ ഗണത്തില്‍ പെടുന്നതായി കണക്കാക്കേണ്ടി വരും.
7.തിരുപ്പതി, ജഗന്നാഥ ക്ഷേത്രങ്ങള്‍ പോലും പ്രത്യേക വിഭാഗമല്ലെന്നു കോടതി പറഞ്ഞിട്ടുണ്ട്.
8.പൊതു ക്ഷേത്രമാണ് ശബരിമല. ഭരണഘടനയ്‌ക്ക് ഇണങ്ങാത്ത ആചാരം നിലനില്‍ക്കരുത്.
9.ആചാരം മൗലികാവകാശങ്ങള്‍ക്ക് വിധേയമാണ്. ആരെയും ഒഴിവാക്കാന്‍ ആകില്ല
10.വിവേചനം പാടില്ല, ഇതാണ് ഭരണഘടനയുടെ അടിസ്ഥാന തത്വം. ക്ഷേത്ര പ്രവേശനമാണ് ഏറ്റവും വലിയ അവകാശം. തുടങ

കുറ്റം തെളിയിക്കുന്നതിനാവശ്യമായ തെളിവുകള്‍ ഹാജരാക്കുന്നതില്‍ പ്രോസിക്യൂഷന്‍ പരാജയപ്പെട്ടെന്നു കണ്ടെത്തിയ പാകിസ്ഥാന്‍ , വധശിക്ഷയ്ക്കെതിരെ ആസിയ നല്‍കിയ അപ്പീല്‍ അംഗീകരിക്കുകയായിരുന്നു.2009 ലായിരുന്നു കേസിനാസ്പദമായ സംഭവം . പാക് പഞ്ചാബ് പ്രവിശ്യയിലെ കൃഷിയിടത്തില്‍ ജോലിക്കിടെ ഒരു മുസ്ലീം യുവതിയുമായി ഉണ്ടായ വഴക്കിൽ മതനിന്ദാ പരമായ പരാമര്‍ശങ്ങള്‍ ആസിയ നടത്തിയെന്ന പരാതിയെത്തുടര്‍ന്ന് അഞ്ചുകുട്ടികളുടെ മാതാവായ ഇവരെ അറസ്റ്റ് ചെയുകയായിരുന്നു . കുറ്റവിമുക്തമാക്കിയ നടപടിയെ അനുകൂലിച്ചും പ്രതികൂലിച്ചുകൊണ്ടും ആളുകൾ രംഗത്തിറങ്ങി .എട്ട് വര്‍ഷം നീണ്ട ഏകാന്ത തടവിനൊടുവിലാണ് വധശിക്ഷ കോടതി റദ്ദാക്കിയത്. അവിശ്വസനീയമെന്നാണ് അവര്‍ കോടതി വിധിയോട് പ്രതികരിച്ചു .ആസിയയെ കുറ്റവിമുക്തമാക്കിയതിനു പിന്നാലെ ആസിയയ്ക്കെതിരായ കുറ്റങ്ങളില്‍ ഭൂരിഭാഗവും അവരുടെ മതവുമായി ബന്ധപ്പെടുത്തി കെട്ടിച്ചമച്ചതാണെന്ന് സുപ്രീം കോടതി കണ്ടെത്തി. രാജ്യത്ത് മനുഷ്യാവകാശവും മതസ്വാതന്ത്ര്യവും അനുവദിക്കുന്നതിനുള്ള കൂടുതല്‍ നടപടികള്‍ ഉണ്ടാവുമെന്നും പാകിസ്ഥാന്‍ കോടതി പ്രത്യാശ പ്രകടിപ്പിച്ചു. 2010 മുതല്‍ കിഴക്കന്‍ പാക്കിസ്ഥാനിലെ മുള്‍ട്ടാണ്‍ പ്രദേശത്തുള്ള ജയിലില്‍ ഏകാന്ത തടവിലായിരുന്നു ആസിയ. ജയിലിനുള്ളില്‍ കൊലപ്പെടുത്തുന്നവര്‍ക്ക് അഞ്ചു ലക്ഷം രൂപ നല്‍കാമെന്ന് ഒരു മുസ്ലീം പണ്ഡിതന്‍ പരസ്യമായി പ്രഖ്യാപിച്ചിരുന്നതിനാൽ സുരക്ഷാ ഭീഷണി തുടർന്നാണ് ഏകാന്ത തടവില്‍ പാര്‍പ്പിച്ചിരുന്നത്. കഴിഞ്ഞ ഒക്ടോബറില്‍ ആസിയയുടെ അപ്പീല്‍ കോടതി പരിഗണിച്ചെങ്കിലും പ്രധാന ജഡ്ജി പിന്‍മാറിയതിനെ തുടർന്ന് കേസ് പരിഗണിക്കുന്നത് സുപ്രീംകോടതി അനിശ്ചിത കാലത്തേക്ക് മാറ്റിവെക്കുകയായിരിന്നു.വിധി പ്രഖ്യാപിച്ചതിന് പിന്നാലെ രാജ്യത്തിന്‍റെ വിവിധ ഭാഗങ്ങളില്‍ മത സംഘടനകളുടെ നേതൃത്വത്തില്‍ പ്രതിഷേധ പ്രകടനങ്ങള്‍ നടന്നു.
