The royal couple is reportedly considering legal action against the photographer and the magazine. The palace also made a statement that clearly looks to shift the shame of Kate's bare chest to the French tabloid's naked ambition, recalling the tragic death of Prince William's mother:
'The incident is reminiscent of the worst excesses of the press and paparazzi during the life of Diana, Princess of Wales, and all the more upsetting to the Duke and Duchess for being so.'.

Two people have been charged over topless photos of the Duchess of Cambridge, it is being reported.
Sources told the AFP news agency the accused are the head of the Mondadori Group - the publisher of glossy magazine Closer where some of the shots were printed - and a photographer at regional daily La Provence.
The photos of Prince William's wife Catherine caused a furore when they were published last September, and sparked a criminal probe into how they were obtained.

Judges in the Paris suburb of Nanterre charged the photographer with 'invasion of privacy' for taking images of the former Kate Middleton in a swimsuit while she was on holiday in the south of France with her husband.
Those shots were published in La Provence, but the most intimate pictures showing the Duchess of Cambridge topless and having sun cream applied by William were published in Closer.
Judges are still investigating who took those photos.
Ernesto Mauri, the chief executive of Mondadori, was also charged with 'invasion of privacy' for allowing the topless shots to be published.
French authorities promptly banned Closer from any further publication or resale of the topless images after they first emerged.

The intrusive topless photos of Kate Middleton could lead to charges being handed out to two people in France, a publisher and a photographer, thought to be involved in the scandal.
The two people have now been put under official investigation and are likely to be charged with 'invasion of privacy' for the Kate Middleton photo scandal that hit last September.
The topless photos, originally published in 'Closer' magazine, were taken while Prince William and Kate were staying at the Chateau d'Autet in Provence, France – a private rural villa.
The first person charged is Ernesto Mauri, the CEO of Mondadori, the company responsible for publishing Closer in France.
The photos outraged the British Royal Family, and especially Prince William, who remembers his mother, Princess Diana, being hounded and chased by the paparazzi in France when her car crashed resulting in her death.
The British Royal Family sued Closer in the aftermath of the Kate photos, and the magazine was ordered to hand over all intrusive photos of Middleton.
'These snapshots which showed the intimacy of a couple, partially naked on the terrace of a private home, surrounded by a park several hundred meters from a public road, and being able to legitimately assume that they are protected from passers-by, are by nature particularly intrusive. Prince William's wife Catherine on Saturday faced growing embarrassment over topless photos after an Italian magazine said it would follow its French sister publication in printing them.
The British royals launched legal action on Friday against French magazine Closer -- which is part of the media empire of former Italian prime minister Silvio Berlusconi -- after it published paparazzi snaps of Catherine sunbathing with her husband.
The royal family may have hoped to contain the scandal by swiftly suing Closer -- but Chi, an Italian weekly also published by Berlusconi's Mondadori Group, announced late Friday that it plans to print a special issue on Monday devoting 26 pages to the candid pictures of the former Kate Middleton.
The pictures were taken while she was on holiday with her husband, the second-in-line to the British throne, in France this month.
Closer's editor Laurence Pieau was quoted by British tabloid The Sun on Saturday as saying her magazine had more pictures that it had not printed yet.
'Intimate pictures exist that we haven't published and will not publish,' she told the newspaper. 'Probably other newspapers will choose to publish them.'

The Italian gossip magazine Chi has said it plans to publish photographs of the Duchess of Cambridge sunbathing topless in a special issue next week.
St James's Palace announced on Friday it was suing the publishers of French magazine Closer that has already printed the pictures of the duchess.
The palace described the photographs as a 'grotesque invasion of privacy'.
No UK titles have published the photos, and the Daily Mail said papers in London had been offered similar images.
Closer and Chi are both part of former Italian Prime Minister Silvio Berlusconi's Mondadori media group.
Chi said, that despite the legal row, it was planning a 26-page photo special of Catherine and William this week.
Editor Alfonso Signorini said: 'The fact that these are the future rulers of England makes the article more interesting and topical.
'This is a deserving topic because it shows in a completely natural way the daily life of a very famous, young and modern couple in love,' he said.
But British newspapers were quick to condemn foreign titles that have published or plan to publish the pictures. The Mail, which revealed it had been offered pictures of the duchess, said that to have used them would have been a blatant breach of the editors' code of practice.
