    ബിഹാറിലെ അഭയകേന്ദ്രങ്ങളില്‍ നടന്ന ലൈംഗിക പീഡന കേസുകളില്‍ പ്രഥമ വിവര റിപ്പോര്‍ട്ടില്‍ ഗുരുതരമായ പിഴവുകള്‍ സംഭവിച്ചുവെന്ന് ചൂണ്ടിക്കാട്ടി സര്‍ക്കാരിന് സുപ്രീംകോടതിയുടെ രൂക്ഷ വിമര്‍ശം. കുട്ടികള്‍ പ്രകൃതി വിരുദ്ധ ലൈംഗിക പീഡനത്തിന് ഇരയായിട്ടും അത് ഒരു കുറ്റമല്ലെന്നാണോ പറയുന്നത്?. ബിഹാര്‍ സര്‍ക്കാര്‍ എന്താണ് അവിടെ ചെയ്യുന്നതെന്നാണ് സുപ്രീംകോടതി ചോദിച്ചു. പ്രകൃതി വിരുദ്ധ ലൈംഗിക പീഡനത്തിന് ഇടയാക്കിയ സംഭവങ്ങളില്‍ കര്‍ശന ശിക്ഷ നല്‍കുന്ന വകുപ്പുകള്‍ ഒഴിവാക്കിയാല്‍ എങ്ങനെ കനത്ത ശിക്ഷ നല്‍കാനാകുമെന്നും കോടതി ചോദിച്ചു. ഇന്ത്യന്‍ ശിക്ഷാ നിയമം 377 (ബലാത്സംഗം), പോക്‌സോ വകുപ്പുകള്‍ ചേര്‍ത്ത് 24 മണിക്കൂറിനുള്ളില്‍ പുതിയ എഫ്.ഐ.ആര്‍ സമര്‍പ്പിക്കാന്‍ കോടതി നിര്‍ദേശം നല്‍കി. അതിപ്രാധാന്യത്തോടെ കൈകാര്യം ചെയ്യേണ്ട കേസാണ് ഇത്. ഓരോ തവണ ഈ ഫയല്‍ നോക്കുമ്പോഴും അത്യന്തം ദുരന്തപൂര്‍ണമായാണ് അനുഭവപ്പെടുന്നത്- കോടതി പറഞ്ഞു. കുട്ടികള്‍ ഇന്ത്യന്‍ പൗരന്മാരല്ലേ എന്നും സുപ്രീംകോടതി ചോദിച്ചു. ഈ സാഹചര്യത്തില്‍ സര്‍ക്കാരിനെതിരെ ഉത്തരവ് ഇറക്കേണ്ടിവരുമെന്നും കോടതി വ്യക്തമാക്കി. മുംബൈയിലെ ടാറ്റാ ഇന്‍സ്റ്റിറ്റ്യൂട്ട് ഓഫ് സോഷ്യല്‍ സയന്‍സസ് നടത്തിയ പഠനത്തിലാണ് ബിഹാറിലെ അഭയ കേന്ദ്രങ്ങളില്‍ കനത്ത മനുഷ്യാവകാശ ലംഘനങ്ങളും ലൈംഗിക പീഡനങ്ങളും നടക്കുന്നതായി കണ്ടെത്തിയത്. പിന്നീട് നടന്ന അന്വേഷണങ്ങളും കണ്ടെത്തലുകളും നിതീഷ് കുമാര്‍ സര്‍ക്കാരിന് തലവേദനയായിരുന്നു. ഇതിന് പിന്നാലെയാണ് കോടതി സര്‍ക്കാരിനെതിരെ തിരിഞ്ഞത്.
