The Supreme Court today referred to a larger bench the petitions seeking review of the apex court’s 2018 judgment allowing entry of women between the ages of 10 and 50 into the Sabarimala temple.Reading out the judgment, the bench said petitions had “sought to revive the debate about what's the religion and essential religious practices”. “Individual right to pray at temple cannot be superior to what is considered as religious by another sect is what petitions have argued,” the court said.

പിഴവുകള്‍ ചൂണ്ടിക്കാട്ടാന്‍ കഴിയുമെന്ന് എൻഎസ്എസ് അഭിഭാഷകന്‍ കെ.പരാശരന്‍ ബോധിപ്പിച്ചു. കോടതിക്ക് തെറ്റുപറ്റി. മതവിശ്വാസത്തിനും അനുഷ്ഠാനത്തിനുമുള്ള ഭരണഘടനാ അവകാശത്തിനെതിരാണ് കോടതി വിധി. മതസ്ഥാപനങ്ങളെ പൊതുസ്ഥലങ്ങളുടെ ഗണത്തില്‍പ്പെടുത്താന്‍ കഴിയില്ല. വിധി ഭരണഘടനയുടെ 25–ാം അനുച്ഛേദത്തിന് വിരുദ്ധമാണ്. പതിനഞ്ചാം അനുച്ഛേദപ്രകാരം ക്ഷേത്രാചാരങ്ങള്‍ റദ്ദാക്കിയത് തെറ്റ്. മതവിശ്വാസങ്ങള്‍ യുക്തിയുടെ അടിസ്ഥാനത്തില്‍ പരിശോധിക്കാനാവില്ല. 15, 17, 25 അനുച്ഛേദങ്ങള്‍ തമ്മിലുള്ള ബന്ധം വിലയിരുത്തിയതില്‍ പിഴച്ചു. യുവതികള്‍ക്ക് പ്രവേശനം അനുവദിക്കാത്തത് അയിത്തമല്ല. തൊട്ടുകൂടായ്മ കുറ്റകരമാണ്, പക്ഷേ അത് കൃത്യമായി നിര്‍വചിക്കണം. ലിംഗവിവേചനം പാടില്ലെന്ന അനുച്ഛേദം മതസ്ഥാപനങ്ങള്‍ക്ക് ബാധകമല്ലെന്നു അഭിഭാഷകന്‍ കെ.പരാശരന്‍ വിശദീകരിച്ചു.
വിധിയിലെ പിഴവുകൾ മാത്രം ചൂണ്ടിക്കാട്ടിയാൽ മതിയെന്നു ചീഫ് ജസ്റ്റിസ് ആവർത്തിച്ചു.
ശബരിമല കേസില്‍ വാദം കേൾക്കവെയാണ് ചീഫ് ജസ്റ്റിസിന്റെ ചോദ്യം. പുന:പരിശോധന ഹര്‍ജികളുള്‍പ്പെടെ ശബരിമല യുവതീപ്രവേശ വിധിയുമായി ബന്ധപ്പെട്ട 65 ഹര്‍ജികള്‍ സുപ്രീംകോടതി പരിഗണിക്കുന്നു. പുനപരിശോധനാഹര്‍ജികളില്‍ ആദ്യം വാദം കേള്‍ക്കുന്നു. ചീഫ് ജസ്റ്റിസ് അധ്യക്ഷനായ ഭരണഘടനാബഞ്ചാണ് ഹര്‍ജികള്‍ പരിഗണിക്കുന്നത്. ഭക്തര്‍ക്ക് അനുകൂലമായ വിധി പ്രതീക്ഷിക്കുന്നതായി പന്തളം കൊട്ടാരം പ്രതിനിധി ശശികുമാരവര്‍മ പറഞ്ഞു. സുപ്രീംകോടതി പറയുന്നത് അനുസരിക്കുമെന്ന് ദേവസ്വംബോര്‍ഡ് പ്രസിഡന്‍റ് എ. പത്മകുമാർ പറഞ്ഞു. യുവതീപ്രവേശ വിഷയത്തില്‍ ഇന്നത്തെ സുപ്രീംകോടതി നടപടികള്‍ നിര്‍ണായകമാണ്. ചീഫ് ജസ്റ്റിസ് രഞ്ജന്‍ ഗൊഗോയ്, ജസ്റ്റിസുമാരായ ആര്‍.എഫ് നരിമാന്‍, എ.എം ഖാന്‍വില്‍ക്കര്‍, ഡി.വൈ.ചന്ദ്രചൂഡ്, ഇന്ദു മല്‍ഹോത്ര എന്നിരടങ്ങിയ ബഞ്ചാണ് പുന:പരിശോധന ഹര്‍ജികളില്‍ വാദം കേള്‍ക്കുന്നത്. സെപ്റ്റംബര്‍ ഇരുപത്തിയെട്ടിലെ വിധി പുന:പരിശോധിക്കണമെന്നാവശ്യപ്പെട്ട് തന്ത്രിയും, അയ്യപ്പഭക്തരും ,സംഘടനകളും നല്‍കിയ 65 പുന:പരിശോധന ഹര്‍ജികളാണ് സുപ്രീംകോടതി പരിഗണിക്കുന്നത്.
ഇതിനുപുറമെ റിട്ട് ഹര്‍ജികളും, ട്രാന്‍സ്ഫര്‍ ഹര്‍ജികളും, സാവകാശ ഹര്‍ജിയും പരിഗണിക്കും.

റിവ്യൂ ഹര്‍ജി തള്ളുകയാണെങ്കില്‍ റിട്ട് ഹര്‍ജികള്‍ വേറിട്ട് തന്നെ പരിഗണിക്കുമെന്നാണ് കോടതി വ്യക്തമാക്കിയത്
ശബരിമല കേസിലെ റിട്ട് ഹർജികളും പുനഃപരിശോധനാ (റിവ്യൂ) ഹർജികൾ വൈകുന്നേരം സുപ്രീം കോടതി പരിഗണിക്കും . എന്താണ് ഇവ തമ്മിലുള്ള വ്യത്യാസം എന്താണ്?ഭരണഘടനാബെഞ്ച് പറഞ്ഞ വിധിക്കെതിരെ റിട്ട് ഹർജി സാധ്യമല്ല. എന്നാൽ, വിധിയെ നേരിട്ടു ചോദ്യം ചെയ്യാതെ, അതു നടപ്പാക്കിയാൽ ഉണ്ടാകാവുന്ന പ്രശ്നങ്ങളാണ് 3 റിട്ട് ഹർജികളിൽ ഉന്നയിക്കപ്പെടുന്നത് . 3 പ്രധാന ആവശ്യങ്ങളാണ് ഇവയിലുള്ളത്: 1) ആരാധനാ സ്വാതന്ത്ര്യം സംരക്ഷിക്കപ്പെടണം, 2) ഭരണഘടനാബെഞ്ചിന്റെ വിധി, പ്രഖ്യാപന സ്വഭാവത്തിൽ മാത്രമുള്ളതാണ് എന്നു വിശദീകരിക്കണം, 3) ആചാരങ്ങൾ സംരക്ഷിക്കാനുള്ള നിർദേശങ്ങൾ നൽകണം.

3 സാഹചര്യങ്ങളിലാണ് റിവ്യൂ അനുവദിച്ച് കേസ് വീണ്ടും വാദത്തിന് പരിഗണിക്കുന്നത്. 1) ഹർജിക്കാർക്ക് അറിയില്ലാതിരുന്നതോ ലഭ്യമാക്കാൻ സാധിക്കാതിരുന്നതോ ആയ പുതിയ തെളിവു ലഭിക്കുമ്പോൾ, 2) വിധിയിൽ വ്യക്തമായ തെറ്റോ പിഴവോ ഉണ്ടെന്നു വ്യക്തമാകുമ്പോൾ, 3) അല്ലെങ്കില്‍ മതിയായ മറ്റേതെങ്കിലും കാരണം.
. റിട്ട് ഹർജികൾ വിശദവാദത്തിനു പരിഗണിക്കാൻ മൂന്നംഗ ബെഞ്ച് തീരുമാനിച്ചാൽതന്നെയും, ആ ഹർജികളുടെ ഭാവി പുനഃപരിശോധനാ ഹർജികളുടെ ഫലത്തെ ആശ്രയിച്ചിരിക്കും. റിവ്യൂ ഹര്‍ജികള്‍ മൂന്ന് മണിക്ക് പരിഗണിക്കുന്നുണ്ട്. ഇതില്‍ കോടതി വാദം കേള്‍ക്കാന്‍ തീരുമാനിച്ചാല്‍ റിട്ട് ഹര്‍ജികള്‍ കൂടി ഇതിനോടൊപ്പം പരിഗണിക്കും

ശുദ്ധിക്രിയ വേണമെന്ന് തന്ത്രിയും മേല്‍ശാന്തിയും തീരുമാനിച്ചതോടെ പരിഹാരക്രിയ നടന്നു. തന്ത്രിയും മേൽശാന്തിയുമാണ് തീരുമാനം എടുത്തത്. ഇക്കാര്യം ദേവസ്വം ബോര്‍ഡിനെ അറിയിച്ചു. ശുദ്ധിക്രിയയ്ക്കായി സന്നിധാനത്ത് നിന്ന് തീര്‍ത്ഥാടകരെ മാറ്റി. പുലര്‍ച്ചെ തുറക്കുന്ന നട സാധാരണ ഗതിയില്‍ ഉച്ചയ്ക്ക് ഒരു മണിക്കാണ് നട അടക്കാറ്. ആചാരം ലംഘനം നടന്നുവെന്ന് തന്ത്രി വിശദമാക്കിയിരുന്നു. നട അടച്ച കാര്യം തന്ത്രി ഫോണിലൂടെ അറിയിച്ചെന്ന് ദേവസ്വം പ്രസിഡന്‍റ് പ്രതികരിച്ചു.
നേരത്തെ ശബരിമലയില്‍ പ്രവേശിക്കാനെത്തി പ്രതിഷേധത്തെ തുടര്‍ന്ന് മടങ്ങിയ ബിന്ദുവും കനകദുര്‍ഗയുമാണ് ശബരിമല ദര്‍ശനം നടത്തിയത്. ഇന്ന് പുലര്‍ച്ചെ 3.45 നോടുകൂടിയാണ് ഇരുവരും ശബരിമല ദര്‍ശനം നടത്തിയത്. ഇവര്‍ മഫ്ടി പോലീസിന്‍റെ സുരക്ഷയിലായിരുന്നു ദര്‍ശനം നടത്തിയത്. 42ഉം 44ഉം വയസാണ് ബിന്ദുവിനും കനകദുര്‍ഗയ്ക്കും.
നേരത്തെ ഈ മാസം 24നാണ് കോഴിക്കോട് കൊയിലാണ്ടി സ്വദേശിനി ബിന്ദുവും, മലപ്പുറം സ്വദേശിനി കനകദുര്‍ഗയും ശബരിമല ദര്‍ശനത്തിനെത്തിയത്.
എന്നാല്‍ കടുത്ത പ്രതിഷേധം കാരണം ഇവര്‍ തിരിച്ചിറങ്ങുകയായിരുന്നു.
മലപ്പുറം അങ്ങാടിപ്പുറം സ്വദേശിയാണ് കനകദുര്‍ഗ.കോഴിക്കോട് കൊയിലാണ്ടി സ്വദേശിയാണ് ബിന്ദു. സുരക്ഷ ആവശ്യപ്പെട്ട് ഇവര്‍ ഇന്നലെ പൊലീസിനെ സമീപിച്ചിരുന്നു.പൊലീസ് ഒരുക്കിയില്ലെങ്കില്‍ സ്വന്തം നിലയില്‍ എത്തുമെന്ന് ഇവർ അറിയിച്ചിരുന്നു. പരിമിതമായ സുരക്ഷ പൊലീസ് വാഗ്ദാനം ചെയ്തിരുന്നു.
പോലീസ് സംരക്ഷണയിലാണ് ദര്‍ശനം നടത്തിയതെന്നും പമ്പയില്‍ എത്തിയ ശേഷമാണ് പോലീസ് സംരക്ഷണം ആവശ്യപ്പെട്ടതെന്നും ബിന്ദു മാതൃഭൂമി ന്യൂസിനോട് പറഞ്ഞു. പമ്പയില്‍ നിന്ന് സന്നിധാനം വരെയുള്ള പാതയില്‍ ഏതാനും ഭക്തര്‍ തങ്ങളെ തിരിച്ചറിഞ്ഞിരുന്നു. എന്നാല്‍ പ്രതിഷേധമൊന്നും ഉണ്ടായില്ല.
ഭക്തര്‍ മാത്രമേ സന്നിധാനത്ത് ഉണ്ടായിരുന്നുള്ളൂവന്നു അവർ പറഞ്ഞു.
