രാജീവ് ഗാന്ധി വധക്കേസിലെ പ്രതികളെ വിട്ടയക്കാമെന്ന് സുപ്രീംകോടതി
കേസിലെ പ്രതികളെ വിട്ടയക്കാനുള്ള തമിഴ്നാട് സര്ക്കാരിന്റെ തീരുമാനം കോടതി ശരിവച്ചു. ജസ്റ്റിസ് രഞ്ജന് ഗൊഗോയ് അധ്യക്ഷനായ രണ്ടംഗ ബെഞ്ചിന്റേതാണ് തീരുമാനം. പ്രതികളെ മോചിതരാക്കണമെന്ന് ആവശ്യപ്പെട്ട് കൊണ്ട് തമിഴ്നാട് സര്ക്കാരിന് ഗവര്ണറെ സമീപിക്കാമെന്നും കോടതി പറഞ്ഞു.
ഇതോടെ 27 വര്ഷമായി ജയിലില് കഴിയുകയായിരുന്ന മുരുകന്, പേരറിവാളന്, ശാന്തന്, നളിനി, റോബര്ട്ട് പയസ്, ജയകുമാര്, രവിചന്ദ്രന് എന്നീ പ്രതികള് ജയില് മോചിതരായേക്കും.പ്രതികളുടെ വധശിക്ഷ നേരത്തെ സുപ്രീംകോടതി ജീവപര്യന്തമാക്കി കുറച്ചിരുന്നു.തുടര്ന്ന് 2016-ല് ജയലളിത സര്ക്കാര് എല്ലാ പ്രതികളേയും വിട്ടയക്കാന് തീരുമാനിച്ചു. ഭരണഘടനയുടെ 161-ാം അനുഛേദ പ്രകാരം സംസ്ഥാനങ്ങള്ക്കുള്ള അധികാരം ഉപയോഗിച്ചാണ് എല്ലാ പ്രതികളേയും വിട്ടയക്കാനുള്ള തീരുമാനമെടുത്തത്. എന്നാല് ഈ തീരുമാനത്തെ ചോദ്യം ചെയ്ത്കൊണ്ട് കേന്ദ്ര സര്ക്കാര് സുപ്രീം കോടതിയെ സമീപിക്കുകയായിരുന്നു. കേന്ദ്ര ഏജന്സികള് അന്വേഷിച്ച ഒരു കേസില് സംസ്ഥാന സര്ക്കാരിന് തീരുമാനമെടുക്കാനാവില്ലെന്നായിരുന്നു കേന്ദ്രത്തിന്റെ വാദം.

9 വർഷമായി അബോധാവസ്ഥയിൽ നിന്നുണരാത്ത മകനു ദയാവധം തേടി മദ്രാസ് ഹൈക്കോടതിയിലെത്തിയ പിതാവിന് കോടതി തിരികെ നല്കിയത് മകനുള്ള പുതിയ ചികിത്സയും അവന്റെ ജീവനും. അപൂർവമസ്തിഷ്കരോഗത്തെ തുടർന്ന് ദിവസം പത്തും ഇരുപതും തവണ അപസ്മാരമുണ്ടാകുന്ന മകനു ചികിൽസകളൊന്നും ഫലിക്കുന്നില്ലെന്നും പരോക്ഷ ദയാവധത്തിന് അനുവദിക്കണമെന്നും ആവശ്യപ്പെട്ടായിരുന്നു പിതാവിന്റെ കണ്ണീർ ഹർജി. കോടതി കുട്ടിയെ പരിശോധിക്കാൻ മൂന്നംഗ വിദഗ്ധസമിതിയെ നിയോഗിച്ചു. സ്ഥിരമായ അബോധാവസ്ഥയല്ല കുട്ടിയുടേതെന്നായിരുന്നു അവരുടെ റിപ്പോർട്ട്. അതിനിടെ, ബാലനു ട്രിഗർ പോയിന്റ് തെറപ്പി എന്ന ചികിൽസ നൽകാൻ തയ്യാറാണെന്ന് അറിയിച്ച് അനിരുദ്ധ മെഡിക്കൽ ഓർഗനൈസേഷൻ കോടതിയെ സമീപിച്ചതോടെ കോടതിയുടെ അനുമതിയോടെ ചികിൽസ ആരംഭിക്കുകയും ചെയ്തു. ആഴ്ചകൾക്കുള്ളിൽ കുട്ടിയിൽ നല്ല മാറ്റങ്ങൾ കണ്ടുതുടങ്ങി.കാര്യങ്ങള് പരിശോധിച്ച മദ്രാസ് ഹൈക്കോടതി, ട്രിഗർ പോയിന്റ് തെറപ്പി ജനകീയമാക്കാൻ നടപടി സ്വീകരിക്കണമെന്നു മെഡിക്കൽ കൗൺസിൽ ഓഫ് ഇന്ത്യയ്ക്കു നിർദേശം നൽകിയിട്ടുണ്ട്. കേന്ദ്ര സംസ്ഥാന സർക്കാരുകളുടെ മേൽനോട്ടത്തിൽ ഇത്തരം ചികിൽസാ രീതികൾ പ്രചാരത്തിലാക്കുന്നതു സമാന മസ്തിഷ്ക രോഗങ്ങൾ ബാധിച്ചവരുടെ കുടുംബങ്ങൾക്കു പ്രതീക്ഷ നൽകുന്നതാണ്. നിർദേശം സംബന്ധിച്ചു കേന്ദ്ര, സംസ്ഥാന സർക്കാരുകളും, മെഡിക്കൽ കൗൺസിലും മറുപടി നൽകണമെന്നും ആവശ്യപ്പെട്ടു. ഈ മാസം 29നു കേസ് വീണ്ടും പരിഗണിക്കും.
