Komisi Pemilihan Umum (KPU) belum mengambil keputusan terkait status pencalonan Ketua Umum Partai Hanura Oesman Sapta Odang ( OSO) sebagai anggota DPD Pemilu 2019.
Putusan yang berbeda antara Mahkamah Konstitusi, Mahkamah Agung dan Pengadilan Tata Usaha Negara (PTUN) membuat KPU perlu mengambil langkah agar seluruh putusan dapat terlaksana.
Komisioner KPU, Wahyu Setiawan mengatakan untuk melaksanakan dan menjalankan seluruh putusan terkait status OSO, pihaknya mengadopsi logika penyerahan Laporan Harta Kekayaan Pejabat Negara (LHKPN).
Nantinya OSO dapat tetap berproses dan masuk dalam daftar calon tetap (DCT) namun dalam waktu setelahnya surat pengunduran diri harus dilampirkan sebagai suatu persyaratan sebelum dilantik.
“Bagaimana kita tetap melaksanakan putusan MK, di mana pengurus partai politik tidak boleh menjadi anggota DPD. Nah itu, nanti ada masa tertentu, di mana yang bersangkutan tetap harus mengundurkan diri apabila terpilih. Sepertinya halnya kita menggunakan analogi LHKPN,” ungkap Wahyu.
Sebelumnya MK mengeluarkan putusan bahwa pengurus parpol tidak dapat menjadi DPD. Namun di sisi lain, MA dan PTUN justru memperbolehkan OSO mencalonkan diri sebagai anggota DPD.

Direktur Eksekutif Perkumpulan untuk Pemilu dan Demokrasi (Perludem) Titi Anggraeni menilai Komisi Pemilihan Umum (KPU) sebaiknya mematuhi putusan Mahkamah Konstitusi, yakni calon anggota DPD dilarang rangkap jabatan sebagai partai politik.
“Calon anggota DPD tidak boleh berlatar belakang sebagai anggota aktif pengurus partai politik,” ucap Titi di Jakarta, Selasa (27/11/2018).
Menurut Titi putusan MK sudah final dan mengikat sehingga harus dipatuhi. Titi menyarankan jika Oesman Sapta Odang ingin mendaftar sebagai calon DPD, maka harus melampirkan surat pengunduran diri sebagai ketua umum parpol.
