मुस्लिम पर्सनल लॉ बोर्ड ने तीन तलाक के मुद्दे पर मोदी सरकार के रवैये पर कड़ी आपत्ति जताई है। मुस्लिम पर्सनल लॉ बोर्ड के जनरल सेक्रेटरी वली रहमानी ने आज प्रेस कॉन्फ्रेंस कर कहा कि देश के मुसलमान लॉ कमिशन के सवालनामे का बॉयकॉट करेंगे और इसमें शामिल नहीं होंगे. उनका आरोप है कि इसे निष्पक्ष होकर तैयार नहीं किया गया है. उनका कहना है कि यूनिफॉर्म सिविल कोड इस मुल्क के लिए मुनासिब नहीं है. इस देश में तमाम धर्म को मानने वाले लोग रहते हैं. संविधान ने हम सबको अपने धर्म की आजादी दी है. सरकार और लॉ कमिशन संविधान के विपरीत काम कर रही है. यह धर्म की आजादी की भावना के खिलाफ है.आपकों बता दें कि ट्रिपल तलाक़ के विरोध में इस महीने केंद्र सरकार ने कोर्ट में हलफ़नामा दाख़िल कर इसका विरोध किया था. हेलफ़नामे में केंद्र ने कहा था कि ट्रिपल तलाक़ महिलाओं के साथ लैंगिक भेदभाव है और महिलाओं की गरिमा से कोई समझौता नहीं हो सकता।मुस्लिम पर्सनल लॉ बोर्ड ने साफ कर दिया है कि लॉ कमिशन के सवालनामे का बहिष्कार करेगी...ऐसे में साफ है कि केंद्र सरकार के लिए यूनिफॉर्म सिविल कोड लागू करना एक बड़ी चुनौती है।...देखते रहिए डीबी लाइव

तीन बार तलाक के मामले में मुस्लिम पर्सनल लॉ बोर्ड ने सुप्रीम कोर्ट में हलफनामा दाखिल कर दिया है और अपने जवाब में कहा है कि तीन तलाक के मामले पर न्यायालय निर्णय नहीं दे सकता है, क्योंकि तीन तलाक का फैसला कुरान से लिया गया है। इस मामले में पिछली सुनवाई में सुप्रीम कोर्ट ने केंद्र सरकार और मुस्लिम पर्सनल लॉ बोर्ड से जवाब मांगा था। सुप्रीम कोर्ट को दिए जवाब में बोर्ड ने कहा कि पर्सनल लॉ को चुनौती नहीं दी जा सकती, ऐसा करना संविधान के पार्ट-3 का उल्लंघन है। यह इस्लाम धर्म से संबंधित सांस्कृतिक मुद्दा है। कुरान में तलाक को अवांछनीय कहा गया है, मगर आवश्यकता पड़ने पर यह तलाक दिया जा सकता है। तलाक समानता का अधिकार है पुरुष और महिला दोनों ही इस अधिकार का इस्तेमाल कर सकते हैं। पर्सनल लॉ बोर्ड का कहना है कि तीन तलाक का नियम सही है। इसे गलत नहीं ठहराया जा सकता है। पर्सनल लॉ बोर्ड ने कहा कि न्यायालय तलाक की वैधता को गलत नहीं मान सकता है। आपको बता दें कि पिछली सुनवाई में सुप्रीम कोर्ट ने सवाल किया था कि अगर इस्लाम के मुताबिक कोई चार शादियां कर सकता है, तो फिर दूसरी शादी के लिए तीन तलाक देने की क्या ज़रुरत है।
