റിവ്യൂ ഹര്‍ജി തള്ളുകയാണെങ്കില്‍ റിട്ട് ഹര്‍ജികള്‍ വേറിട്ട് തന്നെ പരിഗണിക്കുമെന്നാണ് കോടതി വ്യക്തമാക്കിയത്
ശബരിമല കേസിലെ റിട്ട് ഹർജികളും പുനഃപരിശോധനാ (റിവ്യൂ) ഹർജികൾ വൈകുന്നേരം സുപ്രീം കോടതി പരിഗണിക്കും . എന്താണ് ഇവ തമ്മിലുള്ള വ്യത്യാസം എന്താണ്?ഭരണഘടനാബെഞ്ച് പറഞ്ഞ വിധിക്കെതിരെ റിട്ട് ഹർജി സാധ്യമല്ല. എന്നാൽ, വിധിയെ നേരിട്ടു ചോദ്യം ചെയ്യാതെ, അതു നടപ്പാക്കിയാൽ ഉണ്ടാകാവുന്ന പ്രശ്നങ്ങളാണ് 3 റിട്ട് ഹർജികളിൽ ഉന്നയിക്കപ്പെടുന്നത് . 3 പ്രധാന ആവശ്യങ്ങളാണ് ഇവയിലുള്ളത്: 1) ആരാധനാ സ്വാതന്ത്ര്യം സംരക്ഷിക്കപ്പെടണം, 2) ഭരണഘടനാബെഞ്ചിന്റെ വിധി, പ്രഖ്യാപന സ്വഭാവത്തിൽ മാത്രമുള്ളതാണ് എന്നു വിശദീകരിക്കണം, 3) ആചാരങ്ങൾ സംരക്ഷിക്കാനുള്ള നിർദേശങ്ങൾ നൽകണം.
ഭരണഘടനാബെഞ്ച് സെപ്റ്റംബർ 28ന് നൽകിയ വിധിയുടെ തിരുത്താണ് പുനഃപരിശോധനാ ഹർജികളിലെ ആവശ്യം.
3 സാഹചര്യങ്ങളിലാണ് റിവ്യൂ അനുവദിച്ച് കേസ് വീണ്ടും വാദത്തിന് പരിഗണിക്കുന്നത്. 1) ഹർജിക്കാർക്ക് അറിയില്ലാതിരുന്നതോ ലഭ്യമാക്കാൻ സാധിക്കാതിരുന്നതോ ആയ പുതിയ തെളിവു ലഭിക്കുമ്പോൾ, 2) വിധിയിൽ വ്യക്തമായ തെറ്റോ പിഴവോ ഉണ്ടെന്നു വ്യക്തമാകുമ്പോൾ, 3) അല്ലെങ്കില്‍ മതിയായ മറ്റേതെങ്കിലും കാരണം.
. റിട്ട് ഹർജികൾ വിശദവാദത്തിനു പരിഗണിക്കാൻ മൂന്നംഗ ബെഞ്ച് തീരുമാനിച്ചാൽതന്നെയും, ആ ഹർജികളുടെ ഭാവി പുനഃപരിശോധനാ ഹർജികളുടെ ഫലത്തെ ആശ്രയിച്ചിരിക്കും. റിവ്യൂ ഹര്‍ജികള്‍ മൂന്ന് മണിക്ക് പരിഗണിക്കുന്നുണ്ട്. ഇതില്‍ കോടതി വാദം കേള്‍ക്കാന്‍ തീരുമാനിച്ചാല്‍ റിട്ട് ഹര്‍ജികള്‍ കൂടി ഇതിനോടൊപ്പം പരിഗണിക്കും

ശബരിമല വിഷയത്തില്‍ റിട്ട് ഹർജികൾ പരിഗണിക്കുന്നത് സുപ്രീം കോടതി മാറ്റിവെച്ചു.
പുനഃപരിശോധനാ ഹർജികൾ പരിഗണിച്ച ശേഷം റിട്ട് ഹര്‍ജികള്‍ പരിഗണിക്കാമെന്ന് സുപ്രീം കോടതി വ്യക്തമാക്കി. പുനഃപരിശോധനാ ഹർജികൾ ഉച്ചകഴിഞ്ഞു മൂന്നിനു ചീഫ് ജസ്റ്റിസിന്റെ ചേംബറിലാണ് പരിഗണിക്കുന്നത്. ശബരിമല യുവതീപ്രവേശനത്തിൽ പുനഃപരിശോധനാ ഹർജികൾ തുറന്ന കോടതിയിൽ കേൾക്കില്ല. അതേസമയം ശബരിമല സംരക്ഷണ ഫോറത്തിന്റെ ആവശ്യം സുപ്രീംകോടതി തള്ളി. അഭിഭാഷകന്‍ വി.കെ.ബിജുവിന് സുപ്രീംകോടതിയുടെ വിമർശനവും നേരിടേണ്ടി വന്നു. ന്യായമല്ലാത്ത ആവശ്യമാണ് ഉന്നയിക്കുന്നതെന്ന് ചീഫ് ജസ്റ്റിസ് രഞ്ജൻ ഗൊഗോയ് പറഞ്ഞു.
