ചികിത്സച്ചെലവുകാരണം കടക്കെണിയിലാകുന്നവർക്ക് മനുഷ്യത്വപരമായ സഹായമേകാൻ സർക്കാരിന് ഭരണഘടനാപരമായ ബാധ്യതയുണ്ടെന്ന് ഹൈക്കോടതി. രണ്ടുകുട്ടികളുടെ ചികിത്സയ്ക്കെടുത്ത വായ്പയുടെയും ജപ്തിയുടെയും പേരിൽ തെരുവിലിറങ്ങേണ്ടിവരുന്ന കുടുംബത്തിന്റെ നിസ്സഹായത മുന്നിൽക്കണ്ടാണ് ജസ്റ്റിസ് ദേവൻ രാമചന്ദ്രന്റെ ഈ നിരീക്ഷണം.
മലപ്പുറം കരുവാരക്കുണ്ട് സ്വദേശി അലവിയാണ് സർഫാസി നിയമപ്രകാരമുള്ള ജപ്തികാരണം തെരുവിലിറക്കപ്പെടുമെന്ന ആശങ്കയുമായി കോടതിയെ സമീപിച്ചത്.
മലപ്പുറം ജില്ലാ സഹകരണബാങ്കിനെ എതിർകക്ഷിയാക്കിയാണ് ഹർജി.
ഹർജിക്കാരനും ഭാര്യയും രണ്ടുകുട്ടികളുമാണ് വീട്ടിലുള്ളത്. അലവിയെപ്പോലുള്ളവരെ കടക്കെണിയിൽനിന്ന് കരകയറ്റാൻ സർക്കാരിന് എന്തുപദ്ധതിയാണുള്ളതെന്ന് സർക്കാർ കോടതിയെ അറിയിക്കണം. അതേപ്പറ്റി രണ്ടാഴ്ചയ്ക്കകം റിപ്പോർട്ട് നൽകണം. ഹർജിക്കാരനുവേണ്ടിമാത്രമല്ല, സമാനസ്ഥിതിയിലുള്ള മറ്റുള്ളവർക്കുവേണ്ടിയും എന്തുചെയ്യാനാവുമെന്ന് അറിയിക്കണം.
ഹർജിക്കാരന്റെ ഇപ്പോഴത്തെ അവസ്ഥയും കുട്ടികളുടെ ചികിത്സതുടരാൻ സാധിക്കുന്നുണ്ടോ എന്നും മലപ്പുറം കളക്ടർ പ്രതിനിധിയെ വിട്ട് മനസ്സിലാക്കണം.
അതേക്കുറിച്ചുള്ള റിപ്പോർട്ടും രണ്ടാഴ്ചയ്ക്കകം നൽകണം.
ഇതിനായി സർക്കാരിനെയും മലപ്പുറം കളക്ടറെയും കോടതി സ്വമേധയാ ഹർജിയിൽ കക്ഷിചേർക്കുകയായിരുന്നു. ഹർജി ഡിസംബർ 18-ന് വീണ്ടും പരിഗണിക്കും. അതുവരെ ബാങ്ക് ജപ്തിനടപടിയെടുക്കരുതെന്ന് കോടതി നിർദേശിച്ചു. വായ്പക്കുടിശ്ശികയുടെ പേരിലെ ജപ്തിക്കെതിരായ അപേക്ഷയെന്ന നിലയിലാണ് ഹർജി കോടതിക്കുമുന്നിലെത്തിയത്.
എന്നാൽ, പതിയെ അതിനുപിന്നിലെ കടുത്ത സാമൂഹികപ്രശ്നം കോടതി മനസ്സിലാക്കി.
